NAWAC considers that the keeping of sows in farrowing crates does not fully meet the obligations of the Act. Minimum Standard 9 allows for the confinement of sows in farrowing crates for no more than six weeks in any one reproductive cycle.

The 2004 Code of Welfare contained similar wording for sow crates, with the statement that

NAWAC would ideally like to see dry sow stall use completely phased out if viable systems are available which maintain overall welfare of the sow

The government line at the time was not that stalls and crates are totally acceptable, but that there needs to be time to conduct research on alternatives. In taking this line, NAWAC came up with a concept of “net welfare”. The argument is that if one of the 5 freedoms is restricted, then “net welfare” could still be improved overall if there is overcompensation for another freedom. The flawed nature of this argument and its lack of any legal standing has been previously discussed in Chapter 2.
